We value privacy and transparency, and this Privacy Policy outlines how data is handled through www.datarismus.com (the Site”). In this policy, “we”, “us” and “our” refers to Datarismus, its proprietors, employees, officers, directors, agents and consultants (collectively the “Company”) which operate the Site. When we say "you", “your” or "user", we mean a general user of the Site.

BY USING THE SITE, YOU ACCEPT AND AGREE TO BE BOUND BY, AND TO COMPLY WITH, OUR TERMS OF USE AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS OF USE OR THE PRIVACY POLICY, YOU MUST NOT ACCESS OR USE THE SITE.

1. OBJECTIVES AND FUNCTIONS

The Site is divided into three main functions that are reflective of our objectives in improving the accessibility and understanding of data and data science. These involve helping users to:

  • search datasets that are published by third parties to find those that may be of interest to them and/or may be suitable for the application of data science techniques to derive insights;
  • learn and practice data science techniques by reading articles, doing exercises and taking courses;
  • discover insights from data by reading and/or interacting with content on the Site, or request that we undertake data-related services on a consulting basis.
2. WHAT DATA WE COLLECT AND PROCESS

This section outlines the kind of data we collect and process. The ways in which we may collect and process this data, and our reasons for doing so, are outlined in Section 4.

“Personal Data” means any information which relates to a living, identifiable person. Personal Data that we may collect includes your name and email address, as well as the country where you live.

We may collect “Log Data” that your browser sends whenever you visit our Site. This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages and other statistics.

If you submitted data to us via a web-based form on the Site and accessed those forms using a button on the Site, we may record the page of the Site on which the button you clicked to reach the online form was located. Since there is no universally agreed upon standard for responding to Do Not Track signals, we do not respond to those signals at this time.

3. DATA PUBLISHED BY THIRD PARTIES AND EXTERNAL WEBSITES

The Site contains content derived from data published by third parties and licensed in a way that is consistent with most or all aspects of the Open Definition (“Open Data”). The third parties that publish Open Data ("Open Data Publishers") have their own policies regarding the treatment of Personal Data that may differ from our own.

We have developed a search tool collects data about the Open Data ("metadata") such as the title of a dataset and when it was last updated. This metadata is automatically collected from data streams (Application Programming Interfaces or "APIs") that are provided by Open Data Publishers, and we have no control over the content of the metadata. The datasets themselves are stored on the server of the corresponding Open Data Publisher, from where they can be downloaded. We do not publish any data ourselves, nor are the datasets that can be found using the Search tool stored on our servers, hence the content of the datasets is also beyond our control.

In order for the datasets and their metadata to have appeared in the results of our search tool, they must have previously been published by an Open Data Publisher and are therefore already publicly available. Consequently, the Open Data datasets found by our search tool, and their metadata as it appears in search results on our Site, fall outside of the scope of this Privacy Policy.

The Site contains links to external websites that are not operated by us including (but not limited to) links to the websites of Open Data Publishers that appear in search results on our Site. All external website operators have Terms of Use and Privacy Policies that are different to our own, and may be less restrictive and/or protective. Users following those links should review the applicable Privacy Policies and Terms of Use of those sites. We accept no responsibility or liability for the content of external websites or the datasets stored on them, and users follow such links at their own risk.

4. HOW AND WHY WE COLLECT AND PROCESS THE PERSONAL DATA

We collect and process Personal Data to support the objectives and functions identified in Section 1. Specific aims include, but are not limited to:

  • increasing awareness of new tools and content that we may release;
  • boosting enrolment in courses we may make available;
  • improving the accessibility of courses by emailing discount codes to certain prospective students;
  • presenting skills and experience that we believe may be revelant to a potential consulting opportunity;
  • informing and educating through insights that we may have gained through undertaking a case study or other analysis.
We are committed to ensuring that Personal Data is collected and processed in a manner that is lawful, transparent and fair. We also value your time and only want to send you communications that we believe will be of interest to you. The way in which we collect and process your data, and our reasons for doing so, will vary depending on how it was provided to us, as described below.

a) If you have submitted your data via the Site

In order to submit your Personal Data via a web-based form on the Site you must click on a button indicating your consent to the collection and processing of your data and to receive emails per this Privacy Policy.

By doing so, you are consenting to receiving emails at the email address you gave, based on the information you provided and in support of the objectives and functions identified in Section 1.

This consent will be our basis for collecting and processing your data and for contacting you by email. To stop receiving communications from us, you may withdraw your consent at any time as indicated in Section 5.

b) If you have contacted us

If you have contacted us in some other way other than via a web-based form on the Site (whether electronically, by phone, by mail or in person) and have not indicated to us that you do not wish us to contact you, we may follow up with you regarding the subject about which you contacted us. We would do so in the belief that you would expect this of us, and in our legitimate interest to pursue our objectives and functions identified in Section 1.

c) If we have an existing business relationship

If you have signed a contractual agreement with us, or you require us to take steps prior to entering into such an agreement, we will collect and process your Personal Data for that reason. We may send you emails related to the services rendered under that contractual agreement. You may opt out of receiving such communications from us, however please note that this will not prevent us from contacting you as may be required to fulfill any contractual agreement, or to follow up on any outstanding invoices.

d) If your employment-related Personal Data is publicly available

If Personal Data such as your name and email address has been published by the organization that employs you (for example, on the organization's website or via a publicly available API feed), we may contact you if we believe we can offer you a product or service that is relevant to your role. If there is no statement accompanying your published email address saying that you do not wish to receive unsolicited commercial electronic messages at that email address, we may email you at that address for reasons that include, but are not limited to, sharing:

  • insights we may have derived from analysis of Open Data provided by your organization;
  • data science applications we may have identified using Open Data provided by your organization; and
  • a case study, other analysis we may have performed using Open Data from another organization (or a proposal for such work) that we believe may also be applicable to your organization.

We will strive to only send you information that we believe will be relevant to your profession and/or organization. We will also consider its potential to help you in the performance of your duties and/or the objectives of your organization and the potential for a broader public benefit. We will collect and process the publicly available Personal Data, recording that we have sent this information to you along with any responses we may receive from you. Given the time expended in preparing this tailored information at no upfront cost to you, and our finite resources, these steps are necessary for us to monitor our effectiveness in pursuing our objectives in this way for our legitimate interest, as well as yours.

5. IF YOU DO NOT WISH TO RECEIVE FURTHER MESSAGES FROM US

The footers of our emails contain "unsubscribe" links through which you may indicate that you do not wish to receive further emails from us. Alternatively, you may email this request to [email protected]

If you previously consented to the processing of your data and to receiving emails from us, this process has the effect of withdrawing that consent. Otherwise, it has the effect of objecting to our pursuit of our legitimate interests. In both cases, we will cease direct email communications with you as soon as is practicable.

An exception applies to cases where, as stated in Section 4.c), you have entered into a contractual agreement with us. In that case, your opting out of receiving emails does not prevent us from emailing you regarding the projects to which the agreement applies.

Please note that if you have indicated that you do not wish to receive any emails from us, and your employment-related Personal Data is publicly available as described in Section 4.d), we would need to retain a copy of your Personal Data in order to ensure that we can comply with that request. You may also ask us to delete all the data we hold on you as described above, however in doing so you accept the risk that we may contact you in future acting in pursuit of our legitimate interests not realizing that you had previously objected to this.

Please also bear in mind that opting out of receiving emails from us may limit your access to some portions of your site.

6. DISCLOSURE

Personal Data entered via web-based forms on the Site will pass through the servers of Dreamhost and Mailjet. It may also pass through the servers of Google, CloudFlare and Amazon Web Services. We may collect, monitor, store and analyze the data in support of the objectives and functions identified in Section 1.

The aforementioned companies have terms of use and privacy policies that are different to our own, and for which we are not responsible. You should visit these sites to review their terms and privacy policies.

Under no circumstances will we sell your Personal Data, however in addition to the providers listed above we may share it with our employees, advisors and collaborators in relation to specific project-related work with which we are directly involved. Aside from these exceptions, we will not share your Personal Data unless legally compelled to do so.

7. RETENTION, STORAGE AND SECURITY

We encourage users to advise us of changes to their Personal Data. We will periodically review the Personal Data for relevance against our objectives and (to the extent that we are able to independently verify it) the accuracy of the data. Personal Data found to be no longer relevant, inaccurate or outdated will be rectified or deleted as appropriate.

Data collected by us will be stored on the systems of the service providers identified in Section 6. Data will be stored primarily in the United States, Canada and the European Union, however it may be transferred to other jurisdictions. By accessing the Site or providing your Personal Data to us, you expressly consent to the cross-border transfer of your Personal Data.

The Site utilizes Secure Sockets Layer (SSL), a standard security technology that establishes an encrypted link between the Site and your browser, as well as multi-factor authentication. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Consequently, we cannot guarantee the absolute security of your data.

8. DATA PROTECTION RIGHTS

Please email [email protected] if you wish to know what Personal Data we hold about you. If you so request, we will then rectify, update or delete that data as appropriate. Depending on the way in which your Personal Data was provided to us, you may also object to or restrict the use of your data, withdraw consent or request that your data be transferred by emailing us at that same address. Should you wish to exercise this right, please bear in mind the considerations previously outlined in Section 5.

9. CHILDREN

In providing your Personal Data, you represent that you are 16 years of age or older. We do not knowingly collect or retain the Personal Data of users under the age of 16, and if we discover that such a user has provided us with Personal Data, we will delete that data from our records.

10. CHANGES TO THIS PRIVACY POLICY

This Privacy Policy is effective as of the date above and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page. We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Site after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
